Brooke Smith is a member at Stoll Keenon Ogden, joining the firm in 2022 and working out of the Indianapolis, Ind., office. Brooke is highly skilled in business litigation, serving various industries - typically involving business torts, representing individuals, single-member LLCs, and larger, complex organizations in state and federal court.

Prior to joining Stoll Keenon Ogden, Brooke practiced at Katz Korin Cunningham before the firm merged with SKO. Brooke has represented parties in more than fifty matters in federal district courts involving claims for various civil cases, from breach of contract to foreign discovery and federal civil rights matters. Brooke has represented parties in mediations before private mediators and federal magistrate judges, including a mediation resulting in a seven-figure settlement, and has represented parties in numerous Indiana and federal court jury and bench trials.

Brooke’s volunteer and pro-bono work includes founding Classrooms to Courtrooms, a volunteer program designed to broaden the pipeline of diverse and underprivileged students from high school to law school, involvement with the Women’s Fund , an Indianapolis Bar Association Bar Exam Mentor, and a volunteer with the Indianapolis Bar Association Legal Line.

Business Torts: Brooke also represents parties pursuing or defending against business torts, including, but not limited to the following: bad faith, breach of contract, civil conspiracy, conversion, employment torts, fraud and fraud in the inducement, interference with contractual relations, interference with employment, libel and defamation, negligence, nuisance, promissory estoppel, tortious interference, trade secrets, unfair competition, and unjust enrichment.

Labor, Employment, & Employee Benefits: Brooke represents employers and employees in various matters, including, but not limited to, the following: unlawful discrimination case, restrictive covenants, employee handbook drafting/review, employment contract and severance agreement drafting/review, and wage and hour proceedings and planning.

Tort, Trial, & Insurance Services: Brooke and our team of attorneys also represent clients in a variety of tort matters, including, but not limited to, the following: business torts, defamation, fraud, personal injury, premises liability, and property damage.

Appellate Litigation:  Brooke represents clients during all stages of litigation, including through all levels of appeal.  She has represented parties in over fifty matters before the Indiana Court of Appeals, Indiana Supreme Court, and the Seventh Circuit Court of Appeals.  Having submitted numerous briefs and appearing for oral argument, Brooke understands the nuances and expectations of appellate courts.
