James D. Allen

Jim is a Member in Stoll Keenon Ogden’s Lexington office and has been with the firm since 1990. His practice focuses on representing and advising employers in all aspects of Labor and Employment Law.

For his legal successes on behalf of employers, Jim has been listed for many consecutive years in The Best Lawyers of America® peer-review publication and as a Kentucky Super Lawyer for Labor and Employment Law. Among his career highlights is his defense of Kentucky Retirement Systems (KRS) in a collective action claim brought by the EEOC alleging age discrimination in the state’s retirement plan. The case, litigated over 12 years, was heard by the U.S. Supreme Court, which ruled in favor of KRS.

Labor, Employment & Employee Benefits: Jim has litigated and resolved cases for employers that include class and collective actions, and he regularly appears in state and federal courts and before administrative agencies. Outside the courtroom, he is a trusted advisor to many small, medium and large companies. He provides daily compliance assistance and counsel on a broad range of employment matters that include employee discipline, discharge, FMLA and related leave issues, ADA, reductions in force, plant closures (WARN Act), Kentucky OSHA, personnel policies/employment handbooks and wage/hour concerns.

Jim is a member of the Fayette County, Kentucky and American Bar associations. He is also a member of the Labor and Employment Section of the American Bar Association. To give back to the community, he currently serves as Vice Chair of the Board of Directors for Members Heritage Credit Union.

Defended the Kentucky Retirement Systems in a claim brought against it by the Equal Employment Opportunity Commission alleging age discrimination in the state's retirement plan. Case was heard by the United States Supreme Court which ruled in favor of KRS, thus saving the Commonwealth and its taxpayers approximately $70 million dollars.
