Eric M. Weihe

A Member of Stoll Keenon Ogden’s Louisville office since 2008, Eric serves in the Tort, Trial & Insurance Services practice and the Business Litigation practice. His broad depth of experience includes medical negligence defense, insurance defense, personal injury litigation and commercial litigation, particularly for cases involving protection of trade secrets.

Eric also covers wide territory with his client base, which extends across Kentucky. He has represented businesses and professionals in more than 40 of the Commonwealth’s 120 counties. He has defended a multitude of cases in court, and has succeeded in bench and jury trials.

For his many legal accomplishments, Eric has been selected as a Rising Star by Kentucky Super Lawyers® for four consecutive years, and has also been selected for the Benchmark Litigation Under 40 Hot List.

Tort, Trial & Insurance Services: Much of Eric’s practice concentrates on defense against claims relating to medical malpractice, long-term care negligence and insurance bad faith. He represents clients through all stages of the litigation process, from initial discovery to trial and appeal, when necessary.

Business Litigation: Eric specializes in cases involving business torts, environmental law and a range of health care matters. From the outset of a dispute, he works to develop a rapport with clients that is centered on positive results and informed decisions.

Business Torts: Eric routinely handles cases having to do with claims of bad faith, negligence and misappropriation of trade secrets and confidential information.

Environmental Litigation: In this complex area of law, Eric assists businesses in negotiations with state regulatory agencies regarding environmental permitting and compliance.

Health Care: Defending against claims of negligence and malpractice, Eric represents a variety of health care providers, including hospitals, long term acute care facilities, physicians, physical therapists, dentists, nurses and certified athletic trainers.

Work Highlights

Hospital Negligence Defense Opinion in Medical Review Panel

Obtained one of the few no liability opinion from the Kentucky Medical Review Panel on plaintiff’s negligence claims against our hospital client. (October 2018).

Dismissal of Government Entity on Sovereign Immunity Grounds

Obtained dismissal in state circuit court on sovereign immunity grounds for our client in a number of cases on plaintiffs’ negligence claims. (2014, 2015, 2016, 2017).

Landowner Summary Judgment in Slip and Fall

Obtained summary judgment in federal district court for our landowner client on a plaintiff’s slip and fall claim. Mitchell v. Carhartt, Inc., No. 4:14-cv-00057-JHM, 2015 U.S. Dist. LEXIS 148122 (W.D. Ky. Nov. 2, 2015).

Limited Liability Company Summary Judgment in Breach of Duty

Obtained dismissal in federal district court for our publicly held, NYSE-MKT listed client on the grounds that a publicly held corporation owes no duty to monitor or control the purchase, sale, transfer, or exchange of its common stock. Derby Capital, LLC v. General Employment Enterprises, Inc., No. 3:12-cv-00850, 2013 U.S. Dist. LEXIS 73684 (W.D. Ky. May 24, 2013).
